1Acceptance of Terms

By accessing or using Listables ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

• You must be at least 18 years old to use the Service
• Continued use of Listables constitutes acceptance of any updates to these Terms
• We reserve the right to modify these Terms at any time with 30 days notice

2Service Description

Listables provides AI-powered vacation rental investment research and market analysis tools.

3Account Registration

To access certain features, you must create an account using Google OAuth or magic link email authentication.

3.1 Your Responsibilities

• Provide accurate and complete registration information
• Maintain only one account per person
• Keep your login credentials secure and confidential
• Accept responsibility for all activity under your account
• Notify us immediately of any unauthorized account access

4Subscription & Payment

4.1 Free Tier

• 5 AI queries per day (resets every 24 hours)
• Access to basic property search and analysis features
• No payment required

4.2 Pro Tier

• $15/month (billed monthly) or $150/year (billed annually)
• Unlimited AI queries and full feature access
• Payment processed securely via Stripe
• Subscription auto-renews unless canceled
• Cancel anytime — access continues until end of billing period

4.3 Refund Policy

• 14-day money-back guarantee for first-time subscribers
• After the initial 14-day period, all payments are final and non-refundable
• Canceling stops future billing but does not refund the current period
• To request a refund, contact support@listables.com within 14 days of purchase

5Acceptable Use Policy

You agree to use Listables only for lawful purposes and in accordance with these Terms.

5.1 Prohibited Activities

• Scraping, automated access, or reverse engineering the platform
• Attempting prompt injection or extracting proprietary system prompts
• Sharing account credentials or allowing unauthorized access
• Attempting to extract proprietary datasets, algorithms, or trade secrets
• Using the Service for unrelated purposes (general ChatGPT queries, homework, etc.)
• Circumventing rate limits, usage restrictions, or security measures
• Impersonating other users or providing false information
• Engaging in any activity that disrupts or interferes with the Service

6Intellectual Property

6.1 Listables Ownership

Listables owns all intellectual property rights in and to the Service, including but not limited to:

• Software code, algorithms, and AI model configurations
• System prompts and proprietary AI instructions
• Database schemas, business logic, and analytical methodologies
• Branding, logos, trademarks, and design elements

6.2 Third-Party Services & Data

Property valuation data is provided by RentCast. AI analysis is powered by OpenAI. Chat conversations are processed in real-time and are not stored on our servers.

• Not Financial Advice: Listables is an informational tool, not a registered investment advisor, broker, or financial planner. Always consult a licensed professional before making investment decisions.
• No Guarantee of Results: Past performance does not guarantee future results. Real estate investing carries inherent risk of loss.
• Data Accuracy: Property data is sourced from third parties. We do not guarantee accuracy, completeness, or timeliness. Always verify information independently.
• Market Risk: Short-term rental markets are subject to regulatory changes, economic conditions, and competitive dynamics.
• Regulatory Compliance: You are solely responsible for checking local STR regulations, licensing requirements, zoning laws, and tax obligations before investing.

8Limitation of Liability

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied.

8.1 We Are Not Liable For

• Investment losses or financial damages resulting from use of the Service
• Inaccurate property data, market projections, or AI-generated analysis
• Third-party service failures (Stripe, AWS, OpenAI, RentCast)
• Service interruptions, downtime, or technical issues
• Loss of data or inability to access the Service

Maximum Liability: Our total liability is limited to the amount you paid to Listables in the 12 months preceding the claim.

9Termination

• You may cancel your subscription anytime via Settings or the Stripe customer portal
• We may suspend or terminate accounts that violate these Terms
• Upon termination, your right to use the Service ceases immediately
• Deleted accounts and associated data cannot be recovered
• Termination does not entitle you to a refund (except within the 14-day guarantee period)

10Dispute Resolution

• Governing Law: These Terms are governed by the laws of the State of California, USA
• Jurisdiction: Any disputes shall be resolved in the state or federal courts located in California
• No Class Actions: All disputes must be resolved individually, not as part of any class action or collective proceeding

11Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email at least 30 days in advance. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
